Australian Online Betting Laws

A plain-English guide to online wagering, bonus rules, prohibited online casino services and the 2026 reforms.

General information only, not legal advice. Laws, licences and terms can change; check the linked official sources and your state or territory regulator.

Last legally checked 10 September 2026

Australian online betting laws distinguish licensed wagering from prohibited interactive gambling services. A search for a sign up code, sign up bonus, bonus code or promo code does not by itself answer whether an offer is lawful: the offer, channel, recipient, jurisdiction, date and terms matter.[iga][ncpf]

The Interactive Gambling Amendment (Gambling Reform) Act 2026 has been enacted. Sections 1–4 commenced on 26 August 2026, Schedule 5 on 27 August 2026, and the remaining Schedules—including inducement reforms—commence on 1 January 2027.[reform]

Quick facts

Current rule

Licensed wagering is regulated

Online wagering is governed federally and by state and territory rules, licences and conditions. A domain or advertisement alone does not prove authorisation.[iga]

Current rule

No blanket bonus-code ban

The national framework restricts some incentives to open an account or refer another person and sets rules for bonus-bet winnings. It does not establish that every welcome bonus, deposit bonus or free bet is illegal.[ncpf]

Commencing 1 Jan 2027

2026 reform is enacted and partly commenced

The 2026 Act received Royal Assent on 26 August 2026. Its inducement reforms commence on 1 January 2027, not on assent.[reform]

Current rule

Online casino is a separate question

The federal Interactive Gambling Act deals with prohibited interactive gambling services, which can include online casino-style services. Do not treat casino access as equivalent to licensed racing or sports wagering.[iga]

Current rule

BetStop is national self-exclusion

A person registered with BetStop should not try to bypass self-exclusion. Check the register and bookmaker processes for account restrictions.[betstop]

Historical context

Reviews are not current law

Reviews, Bills Digests and explanatory material can explain context, but the official legislation and operative instruments determine legal status.[reform][iga]

Current rule

Are sign-up codes and bonus codes illegal?

Not automatically. A sign-up code, signup code, sign-up bonus, bonus code or promo code may describe an incentive offered when opening an account or using a marketing channel. The national consumer-protection framework restricts certain account-opening and referral inducements, but does not say every promotion is illegal.[ncpf]

A no-deposit bonus, online bonus bet, welcome bonus, deposit bonus, deposit match or free bet must be assessed against its terms, recipient, marketing channel, licence conditions and applicable state or territory law. Do not infer legality from the label alone.[ncpf]

Current rule

Bonus-bet terms in plain English

A free bet commonly returns winnings rather than the stake, but the operator's current terms control. This page does not publish offers, amounts or promises that a named operator's terms comply.[ncpf]

Commencing 1 Jan 2027

What the enacted 2026 reforms change

The enacted Act contains additional restrictions on direct-marketed inducements for defined customers. The reform material describes a 14-day period after a new account and a 90-day period after leaving BetStop or being identified as at risk. Those inducement provisions commence on 1 January 2027.[reform]

This is not a proposed Bill: assent and commencement dates are confirmed in the Federal Register. The staged commencement means sections already in force must be distinguished from Schedules that have not yet commenced.[reform]

Current rule

Online gambling and online casino

Online gambling is not one legal category. Licensed Australian wagering for racing or sport sits alongside federal restrictions on prohibited interactive gambling services. Online casino-style services should be considered in that prohibited-service context, not as equivalent to a licensed bookmaker.[iga][acma]

Offshore branding, a payment method or an advertisement does not establish that an online casino or betting site is authorised in Australia. Check official registers and regulator information before relying on a claim.[iga][acma]

Current rule

Other laws punters search for

In-play betting and live betting have specific restrictions under the Interactive Gambling Act and licensing arrangements. Credit betting is distinct from using a credit card to fund an account: ask what the rule regulates and check the current source.[iga][ncpf][betstop]

Advertising rules, identity verification, deposit limits and account closure can arise from Commonwealth rules, state or territory law, licence conditions and codes. BetStop registration is a self-exclusion status, not a workaround to be bypassed.[iga][ncpf][betstop]

Current rule

How to check a betting-site claim

Start with the Federal Register and the Interactive Gambling Act, then check the relevant state or territory regulator or official register. Confirm the date, service type, licence, recipient and exact promotion terms. A named operator should not be called legal or illegal from a domain, promotion or offshore location alone.[iga][acma]

Frequently asked questions

Are bookmaker sign-up codes illegal in Australia?

Not automatically. Restrictions depend on the incentive, channel, recipient, jurisdiction, date and terms; the national framework does not establish a blanket ban on every sign-up code.[ncpf]

Are bookmaker bonus codes becoming illegal?

Not every bonus code is becoming illegal. The enacted 2026 reform adds defined direct-marketing restrictions, including inducement provisions commencing 1 January 2027.[reform]

What is the difference between a bonus code and a promo code?

They are marketing labels, often for an account or promotion. The label does not decide legality; read the offer, recipient, channel and current terms.[ncpf]

What is a no-deposit bonus?

An incentive described as available without an initial deposit. Eligibility, wagering, expiry and withdrawal terms still matter.[ncpf]

What does deposit match mean?

An offer described as matching some or all of a deposit, usually subject to eligibility and the offer's terms.[ncpf]

Can I withdraw winnings from a free bet?

Often the stake is not returned and winnings may be subject to terms. Check the current operator terms rather than assuming.[ncpf]

Are online casinos legal in Australia?

Online casino-style services must be considered under federal restrictions on prohibited interactive gambling services, separately from licensed wagering.[iga][acma]

Can bookmakers offer welcome bonuses in Australia?

Some incentives may be permitted subject to the national framework, licence conditions and jurisdictional rules. No blanket answer applies to every offer.[ncpf]

Is online in-play betting legal in Australia?

In-play or live betting has specific restrictions under federal law and licensing arrangements; check the current official rules for the service and channel.[iga]

What is credit betting, and is it the same as using a credit card?

Credit betting and using a credit card to fund an account are different concepts. Check which activity the applicable rule regulates.[iga][ncpf]

Can someone registered with BetStop open or use a betting account?

BetStop is a national self-exclusion register. A registered person should not try to bypass it; bookmaker and register restrictions apply.[betstop]

How can I check whether an online betting site is authorised in Australia?

Check the relevant official regulator or register, the service and licence details, and the date. A domain, advertisement or offshore location alone is not proof.[acma]

When would the 2026 gambling reforms start?

The Act received Royal Assent on 26 August 2026; sections 1–4 commenced then, Schedule 5 on 27 August 2026, and all other Schedules including inducement reforms commence 1 January 2027.[reform]
